Client Gallery Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the private online gallery provided to you by Vaka Tara Collective Pte Ltd (“we”, “us”, “our”). By accessing, viewing or downloading images from your gallery, you agree to these Terms. If you do not agree, please do not use the gallery.

These Terms apply in addition to your service agreement or photography/videography contract with Vaka Tara Collective. Where these Terms differ from your services agreement, the services agreement will take precedence.

1. Access to Your Gallery

1.1 Your online gallery is provided for your personal use and for the purpose of viewing, selecting and downloading images from your commissioned project.
1.2 You are responsible for maintaining the confidentiality of your gallery link and any passwords provided.
1.3 You may share the link with family, friends or approved third parties at your discretion.
1.4 We may, at our discretion, disable or remove gallery access after the standard availability period (usually 6 months), unless otherwise stated in your services agreement.

2. Image Usage Rights

2.1 Your rights to use, share and distribute your images are governed by the specific terms set out in your services agreement. Please refer to this document for the full details of your licence.

2.2 Unless your services agreement states otherwise, personal clients generally receive a licence for personal use, which may include:

  • downloading and storing files

  • personal printing

  • sharing with family and friends

  • posting on personal social media (with credit where reasonably possible)

2.3 Commercial clients receive a licence for organisational use as described in their services agreement, which typically includes use for internal communications, marketing, reports, websites and social media.

2.4 You must not:

  • sell, sub-licence or commercially profit from the images

  • provide images to third-party vendors (such as publishers or advertising agencies) unless permitted under your services agreement

  • alter images in a way that materially changes creative intent (for example applying filters that distort colour grading)

3. Copyright

3.1 All images remain the copyright of Vaka Tara Collective unless your services agreement states otherwise.

3.2 The copyright and licensing terms that apply to your project are outlined in your individual services agreement. This agreement takes precedence over any general information provided in these Terms.

3.3 Unless restricted by your services agreement, we retain the right to use images for portfolio, marketing and promotional purposes, including on our website, social media and printed materials. If your project involves sensitive content or confidentiality requirements, please refer to your services agreement or contact us directly.

3.4 Copyright does not transfer to you unless expressly stated in writing within your services agreement.

4. Downloading and File Management

4.1 You are responsible for downloading and safely storing your images before the gallery expiry date.
4.2 Once the gallery expires, we do not guarantee ongoing storage, although re-uploading may be available for a fee.
4.3 If you require alternative formats, custom crops or specific file optimisations, please contact us for assistance.

5. Prints, Products and Third-Party Labs

5.1 You may print your images through the gallery (where available) or through any third-party print provider.
5.2 We are not responsible for print quality, colour accuracy or product outcomes from third-party labs.
5.3 For best results, we recommend using professional printing services.

6. Gallery Platform and Third-Party Providers

6.1 Galleries are hosted through reputable third-party platforms selected for quality, security and user experience.
6.2 We are not liable for outages, data loss, platform changes or service interruptions outside our control.
6.3 By using the gallery, you agree to any terms imposed by the hosting provider (such as Pixieset, Pic-Time, CloudSpot or similar).

7. Privacy and Security

7.1 Your gallery is private and only accessible to those with the direct link (and password, where applicable).
7.2 We take reasonable steps to protect your images; however, no online platform is completely immune to technical issues or unauthorised access.
7.3 You are responsible for managing access once you share your gallery link.

8. Fees and Additional Services

Additional fees may apply for:

  • re-uploading expired galleries

  • extended hosting

  • re-editing or retouching beyond the agreed scope

  • commercial licensing outside your services agreement

  • high-volume file preparation or custom formatting requests

Any additional costs will be discussed and agreed before work begins.

9. Disclaimer and Limitation of Liability

To the extent permitted by law:

  • we are not liable for loss of data, unauthorised access, interruptions or technical issues related to the gallery platform

  • we are not responsible for actions taken by third parties after you share your gallery link

  • images are provided in good faith and with reasonable care, but use of the gallery is at your own discretion

Nothing in these Terms restricts your rights under applicable Fijian consumer law.

10. Changes to These Terms

We may update these Terms from time to time. The most current version will be posted on our website.
